These terms of service apply between the customer and WITAL AB (org. nr. 559468-6254), Fosievägen 29A, 214 31 Malmö, hereinafter referred to as “Wital”, “we” or “us”. By ordering a service or creating an account, you accept these terms.
Wital offers 3D printing, prototyping and product development. The services are specified in more detail in the quote or order confirmation. Estimated delivery times and technical specifications are indicative and may be adjusted according to material and complexity.
A binding agreement is formed when we have confirmed your order by email. We reserve the right to refuse orders deemed unlawful, technically impossible or in conflict with our obligations towards third parties.
You are responsible for ensuring that the information and 3D files sent to us are correct and that you have the right to use the material.
Prices are stated in SEK and include VAT unless otherwise indicated. Shipping fees are added according to the applicable price list. Payment is made according to the method stated in the order confirmation.
In the event of late payment, default interest is charged in accordance with the Swedish Interest Act, plus any reminder and debt collection fees.
Delivery is usually made via Postnord to the address you have provided. Stated delivery times are estimates and are counted from when production has begun. We are not responsible for delays caused by the carrier or force majeure.
The risk for the goods passes to you as the customer upon handover to the carrier if you are a business operator, and upon receipt if you are a consumer.
As a consumer you normally have a 14-day right of withdrawal under the Swedish Distance Contracts Act. The right of withdrawal does not, however, apply to products manufactured according to your own specifications or otherwise given a clear personal touch — which covers most of the 3D prints we deliver.
For standard products that are not custom-made, the right of withdrawal applies and you bear the cost of return shipping yourself. Contact us at [email protected] to exercise the right of withdrawal.
Check the delivery as soon as you have received it. Any faults or damage must be reported without delay, but at the latest within a reasonable time (normally within two months) from when you discovered the fault. Consumers have the right to complain in accordance with the Swedish Consumer Sales Act.
You retain all rights to the 3D files and design materials you provide to us. By ordering, you certify that you have the right to let us manufacture the product and you hold Wital harmless against any claims from third parties.
All content on wital.se — text, images and logo — belongs to Wital AB and may not be used without our written consent.
We are not liable for indirect damages such as lost profit, loss of production or consequential damages. Our liability is in all cases limited to the amount you have paid for the order in question. The limitation does not apply in the case of intent or gross negligence, or where mandatory law provides otherwise.
Wital is not liable for delays or damage caused by circumstances beyond our control, such as labour disputes, government decisions, interruptions to public communications, fire or similar events.
We process personal data in accordance with our privacy policy, which forms an integral part of these terms.
We may update these terms. The version that applied at the time of your order applies to that agreement. The latest version is always published here.
Swedish law applies to the agreement. Disputes are resolved primarily through dialogue. As a consumer, you have the right to turn to the Swedish National Board for Consumer Disputes (ARN), arn.se. Otherwise, disputes are settled by a general court with Malmö District Court as the court of first instance.
